Discussion: Juveniles—Should We Transfer Them to the Adult Criminal System?
An increasing number of juveniles are committing serious and capital crimes. Just about every state has its own statute that identifies relevant crimes that warrant transferring juveniles to adult criminal court to face charges and potentially serve adult prison time. But, this raises the following questions: Given their developmental level and psychological issues, are juveniles sufficiently competent to be in adult court? Should adult sentencing guidelines be followed to place minors in adult prisons? Whose interests are being served when juveniles are placed in the adult criminal system?
In this Discussion, you will analyze the complexities behind juveniles being placed in the adult criminal system.
